Welcome to GaggedDrag.com (“GaggedDrag,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the GaggedDrag website located at gaggeddrag.com, including all content, features, services, and functionality offered on or through the site (collectively, the “Service”).

Please read these Terms carefully before using the Service. By accessing or using GaggedDrag, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

1. Acceptance of Terms

By creating an account, claiming a performer profile, subscribing to a paid tier, making a purchase, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any additional guidelines, policies, or rules posted on the site. These Terms constitute a legally binding agreement between you and GaggedDrag.

You represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

We may update or modify these Terms at any time, as described in Section 12. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

2. Account Registration & Claiming Profiles

2.1 Creating an Account

To access certain features of the Service, you may be required to create an account. When you register, you agree to:

Provide accurate, current, and complete information during registration;
Maintain and promptly update your account information to keep it accurate and current;
Maintain the security and confidentiality of your login credentials;
Accept responsibility for all activities that occur under your account;
Notify us immediately at info@gaggeddrag.com if you suspect unauthorized access to your account.

2.2 Claiming a Performer Profile

GaggedDrag maintains a directory of drag performers. Some profiles may be created using publicly available information. If you are a performer listed on our site, you may claim your profile by verifying your identity through our claim process. By claiming a profile, you:

Represent and warrant that you are the performer identified in the profile, or that you are an authorized representative of that performer;
Accept responsibility for the accuracy of information displayed on the claimed profile;
Agree that any pre-existing public information on the profile may remain unless you request its removal or modification.

2.3 One Account Per Person

Each individual may maintain only one account. We reserve the right to merge, suspend, or terminate duplicate accounts at our discretion.

3. Subscription Tiers, Billing & Cancellation

3.1 Listing Tiers

GaggedDrag offers the following performer listing tiers:

Fresh Meat (Free): Basic directory listing at no charge.
Working Girl ($14.95/month): Enhanced listing with additional features.
Spotlight ($24.95/month): Premium listing with priority placement and expanded profile features.
Crown Jewel ($49.95/month): Top-tier listing with maximum visibility, priority placement, and all premium features.

Venue listings and State/Division Sponsorships are also available at separate pricing. Current pricing for all tiers and sponsorships is displayed on the site and may be updated from time to time.

3.2 Billing & Payment Processing

All paid subscriptions are billed through Stripe, our third-party payment processor. By subscribing to a paid tier, you:

Authorize us (via Stripe) to charge the payment method on file for the applicable subscription fee on a recurring monthly basis;
Acknowledge that your subscription will automatically renew each billing cycle at the then-current rate unless you cancel before the next renewal date;
Agree to keep your payment information current and valid;
Understand that Stripe’s own terms and privacy policy govern the processing of your payment information.

3.3 Price Changes

We reserve the right to change subscription pricing at any time. If we change the price of your subscription, we will provide you with at least 30 days’ advance notice via email before the new pricing takes effect. Your continued subscription after the price change constitutes acceptance of the new price.

3.4 Cancellation

You may cancel your paid subscription at any time through your account settings or by contacting us at info@gaggeddrag.com. Upon cancellation:

Your paid features will remain active until the end of your current billing period;
Your listing will revert to the Free (Fresh Meat) tier at the end of the paid period;
No further charges will be applied after the current billing cycle.

3.5 No Refunds

All subscription payments are non-refundable. No refunds or credits will be issued for partial months of service, upgrade or downgrade changes mid-cycle, or unused time on an active subscription. We do not provide refunds for any reason, including but not limited to dissatisfaction with the Service, failure to cancel before a renewal date, or account termination for violation of these Terms.

3.6 State & Division Sponsorships

State Sponsorships (US) and Division Sponsorships (International) require a one-time Coronation Fee and a monthly Royal Retainer subscription. The Royal Retainer is a recurring monthly charge. If the Royal Retainer lapses (through cancellation, failed payment, or otherwise), the sponsorship spot is forfeited and may be made available to other performers. The Coronation Fee is non-refundable under all circumstances. No more than three (3) sponsorship spots are available per state or division.

4. User Content

4.1 Your Content

“User Content” means any text, images, photographs, bios, performance descriptions, social media links, videos, or other materials that you submit, post, upload, or otherwise make available through the Service. You retain ownership of your User Content, subject to the license granted below.

4.2 License Grant

By submitting User Content to GaggedDrag, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, modify, adapt, and create derivative works of your User Content in connection with operating, promoting, and improving the Service. This license continues for as long as your User Content remains on the Service and for a reasonable period after removal to account for caching, backups, and archival purposes.

You also grant other users of the Service a limited, non-exclusive license to view your User Content as made available through the normal functionality of the site.

4.3 Content Representations

By submitting User Content, you represent and warrant that:

You own the content or have all necessary rights, licenses, and permissions to submit it and grant the licenses described herein;
The content does not infringe, violate, or misappropriate any third party’s intellectual property, privacy, publicity, or other rights;
The content is accurate and not misleading;
The content complies with all applicable laws and these Terms.

4.4 Prohibited Content

You agree not to submit, post, or transmit any User Content that:

Is illegal, fraudulent, defamatory, obscene (beyond the context of drag performance), threatening, harassing, or hateful;
Promotes violence, discrimination, or illegal activities;
Contains sexually explicit material involving minors;
Infringes on any patent, trademark, copyright, trade secret, or other intellectual property right;
Contains viruses, malware, or any other harmful code;
Impersonates another person or misrepresents your affiliation with any person or entity;
Contains unsolicited advertising, spam, chain letters, or pyramid schemes;
Violates the privacy rights of any third party, including posting personal information without consent;
Is otherwise objectionable or harmful, as determined by GaggedDrag in its sole discretion.

4.5 Right to Remove Content

We reserve the right, but have no obligation, to monitor, review, edit, or remove any User Content at our sole discretion, for any reason or no reason, without notice. This includes content that we believe violates these Terms, is objectionable, or may expose GaggedDrag or its users to harm or liability.

4.6 DMCA & Copyright Complaints

If you believe that your copyrighted work has been used on GaggedDrag in a way that constitutes copyright infringement, please send a written notice to info@gaggeddrag.com with the following information:

Identification of the copyrighted work you claim has been infringed;
Identification of the material on the Service that you claim is infringing, with enough detail for us to locate it;
Your contact information (name, address, phone number, email);
A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law;
A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner;
Your physical or electronic signature.

5. Intellectual Property

5.1 Our Intellectual Property

The Service and its entire contents, features, and functionality (including but not limited to the GaggedDrag name, logo, tagline, website design, text, graphics, software, code, data compilations, and the selection and arrangement thereof) are owned by GaggedDrag, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, trade dress, patent, trade secret, and other intellectual property laws.

5.2 Limited License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purposes. This license does not include any right to:

Modify, copy, distribute, or create derivative works based on the Service or its content (other than your own User Content);
Use any data mining, scraping, robots, or similar data-gathering or extraction methods on the Service;
Download or cache any content from the Service (other than standard browser caching) without our express written permission;
Use the Service for any commercial purpose not expressly authorized by these Terms;
Reverse-engineer, decompile, or disassemble any part of the Service.

5.3 Trademarks

“GaggedDrag,” the GaggedDrag logo, “Get Gagged,” “The most sickening drag queen directory in the game,” and all related names, logos, product and service names, designs, and slogans are trademarks of GaggedDrag or its affiliates. You may not use these marks without our prior written permission. All other trademarks, service marks, and trade names used on the Service are the property of their respective owners.

6. Third-Party Links & Services

6.1 Shopify Store

GaggedDrag operates an online merchandise store at shop.gaggeddrag.com (the “Shop”), powered by Shopify. The Shop features products sold through Shopify Collective, meaning products are provided and fulfilled by independent third-party suppliers. GaggedDrag does not manufacture, warehouse, or directly ship these products. Purchases made through the Shop are subject to Shopify’s terms of service and the individual fulfillment policies of each supplier. While we curate the product selection, we are not responsible for product quality, shipping delays, defects, or disputes arising from purchases. Please direct product-specific issues to the relevant supplier or contact us for assistance at info@gaggeddrag.com.

6.2 Amazon Associates & Affiliate Links

GaggedDrag is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com. Certain links on the Service may be affiliate links. When you click an affiliate link and make a purchase, we may earn a small commission at no additional cost to you. These affiliate relationships do not influence our editorial content or directory listings.

6.3 Third-Party Websites & Services

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by GaggedDrag, including performer social media profiles, external booking platforms, and payment processors. We are not responsible for the content, privacy practices, or availability of any third-party sites or services. Your interactions with third-party sites are solely between you and the third party. We encourage you to review the terms and privacy policies of any third-party sites you visit.

6.4 Stripe

Payment processing for subscriptions is provided by Stripe, Inc. Your use of Stripe’s services is subject to Stripe’s Terms of Service and Privacy Policy. GaggedDrag does not store your full credit card number, CVV, or other sensitive payment details directly on its servers.

7. Prohibited Conduct

In addition to the content restrictions in Section 4.4, you agree not to:

Use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law;
Attempt to gain unauthorized access to any part of the Service, other users’ accounts, or any systems or networks connected to the Service;
Interfere with or disrupt the Service, servers, or networks connected to the Service;
Use automated means (bots, crawlers, scrapers) to access or collect data from the Service without our express written permission;
Engage in any activity that could damage, disable, overburden, or impair the Service;
Harvest or collect email addresses or other personal information of users without their consent;
Create a false identity, impersonate any person, or misrepresent your identity or affiliation;
Use the Service to send unsolicited communications or advertising;
Attempt to circumvent any security, rate-limiting, or access-control features of the Service;
Resell, sublicense, or commercially exploit access to the Service without our authorization.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GAGGEDDRAG DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION, CONTENT, OR DATA ON THE SERVICE;
WARRANTIES THAT ANY DEFECTS WILL BE CORRECTED.

GAGGEDDRAG DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PERFORMER, VENUE, PRODUCT, OR SERVICE ADVERTISED OR LISTED ON THE SERVICE. WE ARE A DIRECTORY PLATFORM AND DO NOT VERIFY THE QUALIFICATIONS, SKILLS, BACKGROUND, OR LEGITIMACY OF LISTED PERFORMERS OR VENUES UNLESS EXPRESSLY STATED. YOUR INTERACTIONS WITH PERFORMERS, VENUES, AND OTHER USERS ARE AT YOUR OWN RISK.

PRODUCTS SOLD THROUGH THE SHOPIFY STORE (SHOP.GAGGEDDRAG.COM) ARE PROVIDED BY THIRD-PARTY SUPPLIERS. GAGGEDDRAG MAKES NO WARRANTIES REGARDING THE QUALITY, SAFETY, LEGALITY, OR SUITABILITY OF THOSE PRODUCTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GAGGEDDRAG, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

Your use of or inability to use the Service;
Any conduct or content of any third party on the Service;
Any content obtained from the Service;
Unauthorized access to, use of, or alteration of your transmissions or content;
Products purchased through the Shopify store;
Any performer or venue interactions facilitated through the Service.

IN NO EVENT SHALL GAGGEDDRAG’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO GAGGEDDRAG IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to indemnify, defend, and hold harmless GaggedDrag, its owners, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or related to:

Your use of the Service or any activity under your account;
Your User Content;
Your violation of these Terms;
Your violation of any applicable law or the rights of any third party;
Any dispute between you and another user of the Service;
Any claim that your User Content caused damage to a third party.

This indemnification obligation shall survive the termination of your account and these Terms.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us at info@gaggeddrag.com. If you have an active paid subscription, please cancel it before requesting account deletion to avoid additional charges. Account termination does not entitle you to a refund of any fees previously paid.

11.2 Termination by GaggedDrag

We reserve the right to suspend or terminate your account, with or without notice, at our sole discretion, for any reason, including but not limited to:

Violation of these Terms or any applicable law;
Conduct that we determine, in our sole discretion, is harmful to GaggedDrag, other users, or third parties;
Repeated intellectual property infringement;
Extended periods of inactivity;
Requests by law enforcement or government agencies;
Fraudulent, abusive, or illegal activity.

11.3 Effect of Termination

Upon termination of your account:

Your right to access and use the Service will immediately cease;
Any active subscriptions will be canceled (no refund for the remaining billing period);
We may, but are not obligated to, delete your User Content and account data;
Sections 4.2 (License Grant), 5 (Intellectual Property), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 10 (Indemnification), 13 (Governing Law), and this Section 11.3 shall survive termination.

12. Governing Law & Dispute Resolution

12.1 Governing Law

These Terms and any dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of Ohio, United States of America, without regard to its conflict-of-law provisions.

12.2 Jurisdiction & Venue

You agree to submit to the exclusive personal jurisdiction and venue of the state and federal courts located in the State of Ohio for the resolution of any disputes arising out of or relating to these Terms or the Service. You waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts.

12.3 Informal Resolution

Before filing any formal legal proceeding, you agree to first contact us at info@gaggeddrag.com and attempt to resolve the dispute informally for at least thirty (30) days. Most concerns can be resolved this way.

12.4 Waiver of Class Action

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY CLAIMS OR DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

13. Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make material changes, we will:

Update the “Last Updated” date at the top of this page;
Post the revised Terms on the Service;
For material changes affecting paid subscribers, provide notice via email at least 30 days before the changes take effect.

Your continued use of the Service after the revised Terms are posted constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Service and, if applicable, cancel your subscription.

14. General Provisions

14.1 Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or policies published on the Service, constitute the entire agreement between you and GaggedDrag regarding your use of the Service, superseding any prior agreements.

14.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

14.3 Waiver

The failure of GaggedDrag to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by GaggedDrag to be effective.

14.4 Assignment

You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. GaggedDrag may assign these Terms, in whole or in part, at any time without notice or consent, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets.

14.5 Force Majeure

GaggedDrag shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, government actions, power failures, internet or telecommunications failures, or cyberattacks.

14.6 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights. Nothing in these Terms is intended to confer any rights or remedies on any person other than the parties hereto.

14.7 Headings

The section headings in these Terms are for convenience only and have no legal or contractual effect.
